Welcome to kinnctd! These Terms of Service (“Terms”) constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”), and Plant Build and Restore, Inc. (“we,” “us,” or “our”), concerning your access to and use of the kinnctd mobile application.

By accessing or using kinnctd, you agree that you have read, understood, and agreed to be bound by all of these Terms. If you do not agree with all of these Terms, you are expressly prohibited from using the app and you must discontinue use immediately.

1. App Description and Age Requirements

kinnctd is a community and place-based mobile application. Users can discover meaningful places, follow self-paced or cohort-based journeys, post community stories tied to places, RSVP to events, join interest-based groups, and chat with other members.

Age Requirement: The kinnctd application is intended only for users who are at least 17 years old. By using the app, you represent and warrant that you are at least 17 years of age. If you are under 17, you are not permitted to use the app.

2. Subscriptions and In-App Purchases

kinnctd operates on a 3-tier membership model:

  • Seeker (Free): Full access to view all public Journeys, browse Featured Places and city guides, browse Groups and view Events with attendee counts, save up to 10 Places, and access Group Chats tied to Journeys or Events you are actively part of.
  • Kinnctr ($5.00 USD/month, auto-renewing): Adds the ability to create and join Groups, RSVP and attend Events, direct messaging with other members, unlimited Place saves, and custom Place Collections. Full, unrestricted community participation.
  • Rider ($30.00 USD/month, auto-renewing): A patron tier for members who wish to sustain the platform. Adds Rider Recognition (a permanent badge on your profile), a 48-hour Priority Access window to RSVP for new Journeys and exclusive Events before public release, an end-of-year Annual Gift (a personalized, AI-assisted city insight or cultural deep-dive), Direct Access to the kinnctd team via a private channel, and the satisfaction of directly funding ongoing platform development.

Subscription Terms:

  • Length of subscription: 1 month, automatically renewing.
  • Payment: Payment is charged to your iTunes Account or Google Play Account at confirmation of purchase.
  • Auto-Renewal: Your subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period.
  • Renewal Charges: Your account will be charged for renewal within 24 hours prior to the end of the current period.
  • Management: Subscriptions may be managed by you, and auto-renewal may be turned off, by going to your Account Settings after purchase.
  • Cancellations: No cancellation of the current subscription is allowed during the active subscription period.
  • Refund Policy: All purchases are final. Refund requests are handled by Apple (App Store) or Google (Play Store) per their respective policies. We do not issue refunds directly.

3. User-Generated Content

You may upload photos, videos, reflections, stories, and messages (“User Content”) to the app.

  • Ownership: You retain ownership of all User Content you upload.
  • License to Us: You grant Plant Build and Restore, Inc. a worldwide, non-exclusive, royalty-free, sub-licensable license to host, store, reproduce, modify (only for technical purposes like resizing/transcoding), distribute, and display your User Content solely to operate, provide, and improve the kinnctd service.
  • Termination of License: This license terminates when you delete the content or your account, except for content that has been re-shared or copied by other users, which exists independently.
  • Your Representations: You represent and warrant that you own the rights to the content you upload, that it does not violate any third-party rights, and that it complies with our Prohibited Conduct rules below.

4. Prohibited Conduct

To maintain a safe community, you agree not to engage in any of the following prohibited activities:

  • Hate speech, threats, harassment, or bullying.
  • Uploading sexual content, especially anything involving minors.
  • Promotion of self-harm, suicide, or eating disorders.
  • Doxxing or sharing other users’ personal information without their explicit consent.
  • Spam, phishing, scams, or fraudulent activity.
  • Impersonating any person or entity.
  • Promoting illegal goods or services.
  • Reverse-engineering, scraping, or automated access to the service.
  • Circumventing tier gating or chat moderation systems.
  • Uploading malware or malicious code.
  • Any activity that is illegal in your jurisdiction or under the laws of the State of Oklahoma.

We reserve the right to suspend or terminate accounts that violate these rules, and to remove content that violates them, with or without notice.

5. Apple App Store Specific Terms

If you download kinnctd from the Apple App Store, the following terms apply:

  • This agreement is between you and Plant Build and Restore, Inc. only, not with Apple, and Apple is not responsible for the kinnctd application or its content.
  • Apple has no obligation to furnish any maintenance and support services with respect to the kinnctd application.
  • In the event of any failure of the application to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the application to you (if any). To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the application.
  • Plant Build and Restore, Inc., not Apple, is responsible for addressing any claims you or any third party have relating to the kinnctd application or your possession and/or use of that application.
  • In the event of any third party claim that the application or your possession and use of that application infringes that third party’s intellectual property rights, Plant Build and Restore, Inc., not Apple, will be solely responsible for the investigation, defense, settlement and discharge of any such intellectual property infringement claim.
  • You must comply with applicable third-party terms of agreement when using the kinnctd application.
  • Apple, and Apple’s subsidiaries, are third-party beneficiaries of this agreement, and upon your acceptance of the terms and conditions of this agreement, Apple will have the right (and will be deemed to have accepted the right) to enforce this agreement against you as a third-party beneficiary thereof.

6. Governing Law and Dispute Resolution

Governing Law: These Terms and your use of the app are governed by and construed in accordance with the laws of the State of Oklahoma, United States, without regard to its conflict of law principles.

Arbitration: Any dispute arising out of or in connection with this agreement, including any question regarding its existence, validity, or termination, shall be referred to and finally resolved by arbitration administered by JAMS in Tulsa, Oklahoma.
